การจัดทำความตกลงว่าด้วยเอกสิทธิ์และความคุ้มกันของอาเซียน

·       ไทยได้ลงนามในกฎบัตรอาเซียนเมื่อวันที่ 20 พฤศจิกายน 2550 ซึ่งกฎบัตรอาเซียนได้กำหนดให้รัฐสมาชิกให้ความคุ้มกันและเอกสิทธิ์ที่จำเป็นต่อการปฏิบัติหน้าที่แก่อาเซียน เลขาธิการอาเซียน พนักงานของสำนักเลขาธิการอาเซียน ผู้แทนถาวรประจำอาเซียนของรัฐสมาชิก เจ้าหน้าที่ของรัฐสมาชิก และเจ้าหน้าที่ที่อยู่ระหว่างการปฏิบัติหน้าที่ของอาเซียน โดยอาเซียนจะต้องจัดทำความตกลงว่าด้วยเอกสิทธิ์และความคุ้มกันของอาเซียนในรูปแบบของความตกลงแยกต่างหาก เพื่อกำหนดรายละเอียดของการให้ความคุ้มกันและเอกสิทธิ์ดังกล่าว

·       กระทรวงการต่างประเทศได้เสนอให้รัฐสภาพิจารณากรอบการเจรจาประเด็นด้านกฎหมายภายใต้กฎบัตรอาเซียน ซึ่งรวมถึงการจัดทำร่างความตกลงว่าด้วยเอกสิทธิ์และความคุ้มกันของอาเซียน และเมื่อวันที่ 17 ก.พ. 2552  รัฐสภาได้ให้ความเห็นชอบกรอบการเจรจาดังกล่าว จากนั้น กระทรวงการต่างประเทศจึงได้ร่วมเจรจาจัดทำร่างความตกลงว่าด้วยเอกสิทธิ์และความคุ้มกันของอาเซียนกับประเทศสมาชิกอาเซียนอื่นจนแล้วเสร็จ

·       คณะรัฐมนตรีได้มีมติเมื่อวันที่ 6 ต.ค. 2552 เห็นชอบร่างความตกลงว่าด้วยเอกสิทธิ์และความคุ้มกันของอาเซียน และให้รัฐมนตรีว่าการกระทรวงการต่างประเทศลงนามในความตกลง ร่วมกับประเทศสมาชิกอาเซียนอื่นๆ ในการประชุมสุดยอดอาเซียนครั้งที่ 15 ที่กรุงเทพฯ เมื่อวันที่ 25 ต.ค. 2552 โดยความตกลงดังกล่าว พร้อมคำแปลภาษาไทยอย่างไม่เป็นทางการ ดังปรากฏข้างล่าง

·       ปัจจุบัน กระทรวงการต่างประเทศกำลังอยู่ในระหว่างดำเนินการเกี่ยวกับการออก พรบ. เพื่ออนุวัติการความตกลงฯ ก่อนให้สัตยาบันความตกลงดังกล่าว
